At their core, both policies are anchored in Taiwan’s formal commitment to achieve net-zero emissions by 2050 under the Climate Change Response Act. This legislative framework sets the direction for long-term industrial transformation.
The carbon fee is enabled by the Climate Change Response Act, which provides Taiwan’s legal framework for greenhouse gas reduction and net zero transition. The Ministry of Environment has indicated that the fee will initially apply to power and manufacturing entities emitting more than 25,000 metric tonnes of carbon dioxide equivalent each year.
At the same time, Taiwan's export-led economy faces growing pressure from international mechanisms such as the European Union's Carbon Border Adjustment Mechanism (EU CBAM), which entered its definitive phase in 2026 and applies a carbon price to certain imported goods. The introduction of a domestic carbon fee may help Taiwanese exporters manage a portion of these carbon-related costs locally and prepare for evolving international carbon pricing requirements, although it may not eliminate exposure to overseas carbon charges altogether.
In parallel, Taiwan Government under the ‘5+2 Innovative Industries Plan’ has strengthened controls addressing long-standing issues in soil disposal management. Illegal dumping in farmland or mountainous areas has historically distorted disposal costs and introduced environmental risk on surplus construction soil. From 1st January 2026, transport vehicles for excavated material must use approved GPS tracking to improve traceability and reduce illegal dumping by processing material through legal and auditable channels. The most visible effect the carbon fee policy will have is a shift in project cost baselines with a 0.112% to 0.262% uplift from Ministry of Environment in material costs in 2026, particularly for carbon-intensive inputs such as concrete and steel. In addition, according to the Ministry of Environment's announcement, the carbon fee rate for 2030 is expected to be NT$1,200–1,800 per tonne of CO₂. The carbon fee is estimated accounting for about 0.5% to 1.2% of construction cost. This reflects both direct carbon fees and upstream supply chain adjustments.
At the same time, soil disposal costs are increasing sharply as regulated capacity replaces informal channels. The Director-General of the National Land Management Agency, Tsai Chang-Chan, pointed out that since the new regulations took effect, every step of the disposal process must now comply with legal requirements, driving up construction costs. Using the Tainan social housing project as an example, the proportion of soil disposal costs relative to total construction costs rose from 1.3% to 2.61% in 2026.
This combination creates what is often referred to as a “green premium”; an upfront capital expenditure increase tied to sustainable construction practices.
Global real estate and infrastructure markets are increasingly pricing sustainability into asset value. Where “change in law” provisions are unclear or absent, the risk of disputes is significantly heightened. Contractors may seek to recover additional costs linked to carbon fees, material pricing volatility, or extended construction durations driven by disposal constraints.
